2. Purpose and scope

This Legal Notice governs access to and use of the websites bynut.es and nut.bynut.es (hereinafter, the "Sites"), as well as the services and content available through them, including the skincare routine recommendation tool named NUT (hereinafter, the "Tool").

Access to the Sites implies full and unreserved acceptance of this Legal Notice. Cosmonuts, S.L. reserves the right to modify the content of the Sites and of this Legal Notice at any time and without prior notice.

3. Terms of use

The user agrees to make appropriate use of the content and services offered on the Sites and, in particular, not to use them to:

•        Engage in unlawful or illegal activities or activities contrary to good faith and public order.

•        Disseminate content or propaganda of a racist, xenophobic or pornographic nature or that infringes the rights of minors.

•        Cause damage to the physical and logical systems of Cosmonuts, S.L., its suppliers, or third parties.

•        Introduce or spread computer viruses or any other physical or logical systems that may cause damage to the systems of Cosmonuts, S.L., its suppliers, or third parties.

•        Attempt to access, use and/or manipulate the data of Cosmonuts, S.L., third-party suppliers, or other users.

 

Use of the Sites is reserved for persons aged 18 or over. Cosmonuts, S.L. is not liable for access to or use of the Sites by minors.

4. NUT recommendation tool — Limitation of liability

The NUT Tool, available at nut.bynut.es, generates personalised cosmetic routine recommendations based on the answers provided by the user through an interactive questionnaire.

The recommendations generated by the Tool are for guidance purposes only and in no case constitute:

•        A medical or dermatological diagnosis.

•        A prescription for medical or pharmacological treatment.

•        Professional healthcare advice.

•        A medical device within the meaning of Regulation (EU) 2017/745.

 

The user should consult a doctor, dermatologist, or pharmacist regarding any concerns about their skin health, reactions to cosmetic ingredients, or interactions with ongoing medical treatments. Cosmonuts, S.L. accepts no liability for any damage or loss that may result from use of the Tool without appropriate professional consultation.

Product selection is made exclusively from the byNUT catalogue available at bynut.es. Cosmonuts, S.L. does not guarantee the permanent availability of the recommended products nor their suitability for uses other than ordinary cosmetic use.

5. Intellectual and industrial property

All content on the Sites —including, without limitation, texts, photographs, graphics, images, icons, technology, software, algorithms, recommendation engine, product database, graphic design, and source code— is the property of Cosmonuts, S.L. or of its licensors, and is protected by Spanish and international intellectual and industrial property laws.

The byNUT brand, the logo, and other distinctive signs appearing on the Sites are the property of Cosmonuts, S.L. Their reproduction, distribution, public communication, or transformation without the express written authorisation of the owner is expressly prohibited.

Users accessing the Sites shall only be entitled to private, non-commercial and non-exclusive use of the content, without the possibility of reproducing, distributing, publicly communicating, transforming, or commercially exploiting it.

6. Exclusion of warranties and liability

Cosmonuts, S.L. does not guarantee the availability and continuous operation of the Sites nor the absence of errors in the content. To the extent permitted by applicable law, Cosmonuts, S.L. excludes any liability for damage or loss of any nature that may result from:

•        The unavailability or inaccessibility of the Sites.

•        Interruption in the operation of the Sites or computer failures, telephone breakdowns, disconnections, delays, or blockages caused by deficiencies or overloads in telephone lines, in the Internet system, or in other electronic systems.

•        The presence of viruses or malicious or harmful programs in the content transmitted, disseminated, stored, made available, or accessed through the Sites.

•        Unlawful, negligent, or fraudulent use of the Sites by users, or use in breach of this Legal Notice.

•        The lack of lawfulness, quality, reliability, usefulness, and availability of services provided by third parties and made available to users on the Sites.

7. Third-party links

The Sites may contain links to third-party websites. Cosmonuts, S.L. has no control over such sites or their content, and accepts no liability for them. The inclusion of a link does not imply any type of association, merger, or participation with the linked entities.

8. Privacy and cookies

The processing of users' personal data is governed by the byNUT Privacy Policy, available at bynut.es/pages/privacidad, which forms an integral part of the terms of use of the Sites.

The Sites use only local storage (localStorage) that is technically essential for the operation of the NUT Tool. No advertising or third-party tracking cookies are used. For more information, please consult the Privacy Policy.

9. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. For the resolution of any dispute arising from access to or use of the Sites, the parties submit, expressly waiving any other jurisdiction that might apply to them, to the jurisdiction of the Courts and Tribunals of the city of Barcelona.

Where the user qualifies as a consumer, the consumer protection rules in force in Spain shall apply, in particular Spanish Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Consumer and User Protection Act.
